1. Introduction

These Terms of Service (the “Terms”) are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the website at billjot.com and www.billjot.com (the “Site”) and any related mobile or software applications whether existing now or in the future (“the App”) of billjot Food Services Private Limited (“billjot” or “We” or “Us”).

By downloading or otherwise accessing the App, you agree to be bound by these Terms, our privacy policy, and License Agreement. If you have any queries about the App or these Terms, you can contact Us by any of the means set out in paragraph 11. If you do not agree with these Terms, please stop using the App immediately.

2. Definitions

• “Services” include business applications like Feedback Management and Waiting Queue Management mobile apps integrated with billjot PoS.
• “Content” refers to all material created and provided by billjot in connection with the Services (e.g., visuals, interactive features, graphics, software, usage data), excluding Your Content and third‑party content.
• “Your Content” refers to content you upload via the Services (e.g., likes, reviews, images, customer data, table usage information).

3. General Rules Relating to Conduct

• You have a personal, limited, non‑exclusive, non‑transferable license to use the App as permitted by these Terms.
• You may not use the App unlawfully, interfere with its operation, reverse-engineer it, or gain unauthorized access to its systems.
• You must comply with all applicable laws of India and any relevant international regulations.
• You agree to indemnify billjot and its affiliates against any loss or liability resulting from your improper use of the App.

4. Intellectual Property Rights and Content

• billjot owns all rights, titles, and interests in the Services and our proprietary Content, including all copyrights, trademarks, and trade secrets.
• You acknowledge that the Services consist of original, valuable intellectual property created by billjot.
• You must notify us of any suspected infringement of intellectual property rights involving the Services.
• You shall not disclose any confidential information provided by billjot without prior written consent.
• By submitting Your Content, you grant billjot a perpetual, royalty-free right to use it for any purpose, including third-party integrations, and waive any moral rights.
• You represent that Your Content is your own, not submitted via bots, and does not infringe any laws or others’ rights.

5. Free Trial and Fees

• A free trial of the App is available for one week (or as specified during signup). Eligibility will be communicated at that time.
• After the free trial ends, your Payment Method will be billed an annual fee unless the App is uninstalled before the trial period ends.
• No refunds or credits will be issued for partial membership periods.
• billjot reserves the right to change service plans and pricing at any time.

6. Privacy Policy

billjot values your privacy. Your personal data will be handled in accordance with our privacy policy. By using the App, you confirm that you have read and agree to the privacy policy and these Terms.

7. Disclaimer / Liability

• USE OF THE APP IS AT YOUR OWN RISK.
• The App is provided “AS IS.” billjot disclaims all liability to the fullest extent permitted by law, including any implied warranties of performance, quality, or fitness for purpose.
• billjot is not responsible for technical failures or damages arising from use of the App.
• Your statutory rights remain unaffected.
• billjot is not liable for any economic loss, reputation loss, or indirect damages.
• If liability is established, it is limited to the amount you paid for the App or in‑App purchases.

8. Service Suspension

billjot may suspend or discontinue the App at any time, with or without notice, and will not be liable to you for doing so.

9. Advertisements in the App

billjot is not responsible for any third-party advertisements displayed in the App. Transactions made with advertisers are at your own risk, and any disputes must be resolved directly with them.

10. General

• These Terms constitute the entire agreement between you and billjot regarding the App.
• billjot may amend these Terms; the updated version will be available via a link in the App. Continued use signifies acceptance.
• Any amendments must be in writing and signed by an authorized billjot representative.
• Communications regarding your account (e.g., payment, password changes, confirmations) will be sent electronically.
• These Terms are governed by Indian law and jurisdiction lies exclusively with the courts of Ahmedabad, Gujarat, India.
• If any provision is deemed invalid, it will be modified to reflect the intent, and the rest of the Terms will remain in effect.
• Failure by billjot to enforce any provision does not constitute a waiver of its rights unless acknowledged in writing.
